This article intends to look at the proposed provisions of the Housing Consumer Protection Bill, 2019 which relate to the regulation of the building contract between the home builder or developer and the housing consumer. All of the contractual clauses are novel to the proposed Bill and are not included in the current Housing Consumers Protection Measures Act, 95 of 1988. These provisions, once they are enacted, will create default protection for the parties to a home building contract similar to those included in the standard form building contracts.
