Acted on behalf of project owner in a high value dispute with the design build contractor on a 150 bed regional hospital in relation to a rejected compensation event.

Acted on behalf of the developer in a dispute with the contractor on a 720 bed student housing development in relation to variation orders and contract interpretation.

Acted on behalf of the project owner in a dispute with the contractor on a 148 room hotel relating to a disputed final account.

Acted on behalf of a project owner in a dispute with the design build contractor on a warehouse in relation to a rejected claim for additional costs resulting from unforeseen ground conditions.

Acted on behalf of the implementing agent in a high value dispute with the design build contractor on a 25km roads project relating to a disputed termination.

Acted on behalf of the developer of a 5MW run-of-river hydro power project to negotiate and draft the contract documents for the civil works, water to wire and balance of plant contract packages.

Acted on behalf of the developer of a 130 bed, 4 theatre private hospital with consulting rooms and housing for 200 nurses to advise and draft the commercial structure, negotiate the equity and debt funding, draft loan and security agreements and the consultant appointments.

Acted on behalf of a lender to prepare execution documents for their niche property development funding product.

Provided contractual and commercial advice to a project owner in relation to the refurbishment of an existing hotel.

Acted on behalf of architect firm appointed by design build contractor appointed for the design and construction of a new regional airport to negotiate their appointment including the appointment of their international sub-consultants

Provided contractual and commercial advice to a contractor appointed under a Design Build Operate Maintain contract arrangement in relation to the operation, maintenance and replacement of existing intelligent freeway management services as well as the construction of replacement and new equipment .

During the course of 2025 I approached the Roelf Nel Incorporated team for assistance when a dispute arose with a homeowner following the completion of a residential building project. Despite having fulfilled my contractual obligations, the homeowner withheld the retention monies on the basis of alleged defects and, following a breakdown in our relationship, went so far as to lodge a complaint against my company with the NHBRC.
From the outset, I received clear, practical, and confident advice. The team demonstrated a strong understanding of construction law and the NHBRC framework, and guided me through the process with professionalism and precision. They were instrumental in asserting my contractual rights, particularly in circumstances where the homeowner had not complied with their own financial obligations. Through their strategic approach and firm negotiation, the matter was resolved by way of a settlement agreement in which both parties agreed to forfeit their respective claims, and the NHBRC complaint was formally withdrawn. This brought the dispute to a clean and final conclusion, allowing me to move forward without ongoing risk or uncertainty.
